Citizenship

If you have already spent years living in the United States with a green card, it may be time to obtain full United States citizenship. Citizenship provides far greater protection and rights than lawful permanent residence does. The process to obtain citizenship is normally straightforward, but serious challenges can arise—especially for those with a criminal record or extended absences from the United States. We can help you decide if it is time to apply, then work with you to prepare the application on your behalf or review an application that you have prepared.

Family Petitions

People with close family members who are citizens or lawful permanent residents may receive green cards through their family. Some are allowed to apply for a green card immediately, while others must submit an initial petition and then wait, often for years, for a visa to become available. Still others are required to leave the United States entirely and complete the process from abroad. We can help you identify and pursue the best option for you and your family.

Work Visas

A variety of employment visas are available in the United States. In most cases, employers are required to undergo a labor certification process before they can hire an employee who is not a citizen or green card holder. If the visa application is approved, family members may also be able to immigrate with the employee.

  • EB-1 visa: This visa is available to those who can demonstrate extraordinary ability in their field, outstanding professors and researchers, and certain multinational managers and executives.

  • EB-2 visa: This visa is available to those who can demonstrate exceptional ability in their field, or to professionals holding advanced degrees. Many will need to go through a labor certification process, but some high-demand professions are exempt as well as applicants who can show that their endeavor will be in the U.S. national interest.

  • EB-3 visa: This visa is available to skilled workers whose jobs require two years of experience or training, professionals with a bachelor’s degree, and other workers who meet the educational, training, or experience requirements of the job opportunity. As with EB-2 visas, some high-demand occupations are exempt from the labor certification process.

  • Other work visas, such as H1B visas, offer only temporary status rather than permanent residence. Whatever your situation, we can work with you and your employer to identify the best option for you and apply for a visa.

Public Interest / Humanitarian Options

  • Asylum: People who fear returning to their home country because of persecution may qualify for asylum. In most situations, there is a one-year deadline from the date of entry to the United States to apply. Though asylum is supposed to help the most vulnerable, the legal requirements to win an asylum case are complicated and the consequences for losing the case can be severe. Please reach out to us before attempting this on your own.

  • Special Immigrant Juvenile Status: Children who have been abused, abandoned, or neglected by a parent may be eligible for immigration relief through Special Immigrant Juvenile Status. This process requires a custody action in state court followed by an immigration petition. Our office can help with the immigration petition if you are living in the United States and have a custody order. If you are living in the state of Georgia, we can represent you in the custody petition as well.

  • T visas (for survivors of trafficking): Many forms of sexual exploitation or exploitation for labor can rise to the level of trafficking. To help the United States combat these crimes, T visas are open to immigrant survivors. T visa applications can unfortunately be quite complex, and generally require cooperation with law enforcement. If you are in a safe and stable situation now but have been exploited by someone in the past, we can help you decide whether to apply for a T visa and then help you navigate the process. If you or someone you know is currently in an exploitative situation, call the Human Trafficking Hotline at 1-888-373-7888.

  • U visas (for survivors of serious crimes): U visas exist to help the United States combat crime. People who have suffered serious mental or physical abuse due to crime committed in the United States may qualify for a U visa with a path to a green card. This petition requires a certification from law enforcement, with other documents and evidence. We can help you navigate the process so that you can focus on recovery.

Ju Heon Shin, Esq.

Founding Attorney

Ju Heon is the founding attorney of Shin Firm. An alumnus of Oxford College of Emory University and Georgia State University College of Law, Ju Heon has handled thousands of cases, fighting to ensure clients receive what they deserve. He genuinely enjoys representing those who have been injured, holding insurance companies accountable, and serving the Atlanta community, including his local church.

Leah is an attorney at Shin Firm. After graduating Emory University and Georgia State University College of Law, she worked as a paralegal at Kim Law Firm and later as an Assistant Solicitor General at the Fulton County Solicitor’s Office. She is passionate about taking care of clients who are injured and enjoys being a resource for those unfamiliar with the law in the US, as she is deeply invested in the diverse community in Clarkston, GA.

Hilary Hu, Esq.

Attorney

Hilary is an attorney at Shin Firm with a diverse background in immigration, insurance defense, and corporate law. After graduating Emory University School of Law, she has represented clients in deportation proceedings, defended over 40 bench trials in a year as in-house counsel for one of the nation’s major insurers, and specialized in contract negotiations for a global IT company. She enjoys guiding clients through complex legal matters, especially in the aftermath of motor vehicle accidents, and is passionate about securing fair compensation for them.

Kevin Jackson, Esq.

Attorney

Kevin is an attorney at Shin Firm with a background in immigration. He became an immigration attorney because he grew up internationally and believes that everyone should be treated with hospitality. After receiving his B.A. in History from Ouachita Baptist University, he taught abroad for two years at international schools in Asia. He received his J.D. from the University of Virginia School of Law in 2020 and has been working for immigrants ever since. Before joining Shin Firm, he was a legal fellow and then staff attorney at Kids in Need of Defense in Atlanta. He has helped his clients successfully navigate immigration matters ranging from trafficking victim visas to U.S. citizenship. He speaks English and Spanish.
